Dateclub Terms and Conditions

Introduction

The services offered by this website and WAP Site ("the site") are provided to you ("the user") by BlackHatMedia Information Technology cc 2003/051096/23 ("the company").

The site allows you to share your mobile phone photos and videos with a group of invited friends ("buddies"). By using this site you warrant that you accept and agree to these terms and conditions.

Disclaimer

The Site is provided on an "as is" and "as available" basis. The company uses its best efforts to maintain the quality of the site, but makes no warranty that the site will meet your requirements, be uninterrupted, complete, timely, secure or error free.

The company reserves the right to suspend or cancel the site at any time at the sole discretion of the company. The company is not responsible for any loss or damage caused by such a suspension or cancellation.

Indemnity

You agree to indemnify and hold harmless the company, its officers, directors, employees, agents, affiliates, partner sites and third parties, from any loss, claim or damage, including reasonable attorney's fees, arising out of or resulting from your use of the site.

Code Of Conduct

You agree not to use the site in any way (including to transmit any content) that is contrary to any applicable law or regulation or these terms, or is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of privacy, hateful, or racially, ethnically or in any way otherwise objectionable.

You agree not to use the site to infringe the privacy rights, property rights, or any other rights of any person.

The company may at its sole discretion and without any prior notice bar you from using the site should the company deem you to be in breach of these terms.

Content

The company reserves the right to exercise editorial control over all content added by users of the site.

You shall remain solely responsible for the content of your profile, and all public postings, messages and files that you add to the site.

Privacy

Information shall only be collected and stored for the purposes of managing and maintaining the site.

The company undertakes not to transfer personally identifiable user information to any third party without your express consent or unless requested to do so by an order of the court or by a law enforcement agency or where you have used the site in an unlawful manner.

Costs of Using the Service

Use of the site incurs a cost of R7 per week. Regular WAP charges apply. You must obtain the bill payers permission to use the site.

Credits

Credits have no value other than their use on this site and cannot be transferred, exchanged for cash or refunded.

Jurisdiction

These terms and conditions, their validity, existence or termination, or any other disputes arising in relation to these terms and conditions shall be governed and/or determined in accordance with the law of the Republic of South Africa.

Whole agreement

These terms and conditions constitute the entire agreement between you and the company. Neither you nor the company shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein.

The company is entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms and conditions to any third party.

Severability

If any provision in these terms and conditions is invalid or unenforceable under applicable law, such provision will be inapplicable, but the remaining provisions of this agreement will continue in full force and effect.
